Served as Lead Counsel in Major Medical Device MDL
SouthBank Legal served as co-national counsel to a publicly traded medical device company, one of the world’s largest orthopedic manufacturers, in nationwide litigation involving more than 3,000 product liability lawsuits related to hip implant devices. SouthBank Legal coordinated federal multidistrict litigation in MDL No. 2391 in the Northern District of Indiana and individual and consolidated proceedings in dozens of state and federal courts across the country. SouthBank Legal worked together with a multidisciplinary team of attorneys from national law firms to navigate issues such as jurisdictional challenges; multi-state and international discovery disputes; scientific experts and evidence; complex e-discovery; developing a company case strategy and supporting witnesses; and handling the depositions of hundreds of plaintiffs, surgeons, and sales representatives. SouthBank Legal’s advocacy helped its client to secure strategic discovery wins in the MDL, leading to the negotiation of a global settlement program that resulted in the favorable resolution of thousands of cases and claims through dismissals and settlement.
